Hire Contract Terms & Conditions

1.      Definitions

Commencement Date: The later of the date on the hire agreement or the delivery date of the equipment to the customer.

Equipment: Sydney Site Cam’s video-monitored intruder detection system, including detectors, poles, solar panels, and monitoring units.

Hire Charge: The amount payable by the customer, as stated in the hire agreement.

Hire Period: From the Commencement Date until the equipment is returned to and received by Sydney Site Cam.

📌 Note: You are responsible for the equipment until it is returned and received by Sydney Site Cam.

2.      Our Responsibilities

We agree to:

2.1.           Provide you with the equipment in clean and working condition.

2.2.            Allow you to use the equipment for the agreed hire period.

2.3.           Repair or replace equipment that fails through no fault of yours.

2.4.           Collect the equipment within 5 business days of your written email request.

3.      Your Payments

You agree to:

3.1.           Pay the Hire Charge by the agreed date.

3.2.           Cover all applicable taxes, GST, stamp duties, and delivery/collection costs.

3.3.           Allow Sydney Site Cam to debit any overdue amounts from your nominated account.

3.4.           In case of late payment, you will also be responsible for:

3.4.1.     A 10% monthly late fee (calculated daily).

3.4.2.     All recovery costs, including debt collection or legal fees.

4.      Your Responsibilities

You agree to:

4.1.           Indemnify Sydney Site Cam against any injury or damage arising from use or operation of the equipment.

4.2.           NOT tamper with, modify, or attempt to repair the equipment.

4.3.           NOT sub-hire, lose, sell, or part with possession of the equipment.

4.4.           Only rely on written information provided in this agreement.

4.5.           Responsibility for Equipment On Site

4.6.           Please note that our insurance does not cover the equipment while it is on your site.

4.7.           You accept full responsibility for any loss, theft, or damage from delivery to return. In the event of any such incident, you must:

4.7.1.     Notify us immediately in writing.

4.7.2.     Continue paying hire charges until equipment is repaired or replaced.

4.7.3.     Pay the full cost of repair or full replacement value (as determined by Sydney Site Cam).

4.7.4.     Cover any related administrative or recovery fees.

🔒 We strongly recommend arranging your own insurance to protect the equipment while it is on your site.

5.      Limitation of Liability

5.1.           We are not responsible for any loss or damage you suffer, including indirect or consequential losses, resulting from the use or failure of the equipment.

6.      Breach of Agreement

6.1.           If you breach any term of this agreement, or become insolvent or bankrupt:

6.2.           We may terminate the agreement immediately.

6.3.           We reserve the right to pursue recovery of all outstanding charges and damages.
